Public-Private Partnership

A public-private partnership (PPP) represents a form of long-term and mutually beneficial cooperation between the state and private investors. For now, PPP practice is a dynamically developing and top priority practice area of K&A. Our PPP team is unique in the sense that it is a pioneer in this area and the first in the history of the country who participated in all stages of the first PPP Hemodialysis Project in Kyrgyzstan, from preparing a feasibility study to organization and holding the tender for the selection of a private partner, and signing the PPP agreement with the selected private partner. Apart from project services, our PPP team also provides legislative drafting services, in particular, it made considerable input to the drafting of the current PPP Act and implementing regulations, as well as the new PPP Bill.

For the time being, our PPP team is ready to provide professional legal services at all stages of a PPP project, from its initial stage to final stage, specifically:

Legal support of the PPP project from initiation to completion, including the tender process and negotiation between the public partner and the winning bidder;

Preparation and structuring of the PPP project;

Legal due diligence of the PPP project;

Assessment of the prospects of the PPP project and identification of legal risks, as well as ways to mitigate or avoid them;

Drafting of tender documentation, PPP agreement, as well as other documents necessary for holding a tender and selecting a private partner for the PPP project;
