Elina Pak is a Senior Associate at K&A, she is specializing in the following areas Corporate Law & Capital Markets, Energy, Mergers & Acquisitions, Business Structuring & Reorganization, Taxation, Labor & Migration Law, and Intellectual Property. Elina joined K&A in 2018 and has extensive experience advising foreign investors, international organizations, and local companies on a wide range of legal matters, including renewable energy, public-private partnerships (PPP), contract law, corporate governance, taxation, and more. In addition, Elina is a certified patent attorney and a licensed attorney-at law (advocate) of the Kyrgyz Republic.
• Advised numerous foreign companies on the construction and operation of renewable energy facilities in the Kyrgyz Republic, including preparing memoranda on regulatory aspects and practical implementation of projects. Participated in drafting a roadmap listing the licenses, permits, and accreditations required by Kyrgyz legislation; drafted agreements for structuring and implementing projects; assisted in registering project companies; prepared memoranda on possible financing mechanisms, and more.
• Collaborated with international financial and technical consultants to analyze the renewable energy sector in Kyrgyzstan, identifying gaps in the legislation and providing recommendations.
• Advised foreign clients on investment in capital, security arrangements, market entry strategies, including registration, taxation, licensing, as well as labor and migration regulations for foreign employees.
• Represented clients in courts on labor, civil, and intellectual property disputes, and provided counsel during pre-litigation settlement stages.
• Conducted legal due diligence for several Kyrgyz companies, including corporate governance and compliance reviews, and verified mining licenses for various Kyrgyz mining companies.
• Advised both foreign and local companies on intellectual property matters, including trademark registration, customs control, copyright infringement, and unfair competition.
